These Terms and Conditions ("Terms") govern your use of the App, provided by Xerxes Limited ("we", "us", or "our"). By installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Purpose and scope

The App provides tools to read and write supported NFC tags, scan and create QR codes, and view or save scan history. Features may vary by device, Android version, tag type, and app version.

2. Eligibility and your account

You must be legally able to agree to these Terms under the laws applicable to you. The App is not directed to children under 13 or the minimum age required by local law.

You may use available guest features or sign in using Google. You are responsible for maintaining access to your device and Google account and for activity performed through your account. Do not impersonate another person or provide misleading account information.

Guest data may be stored locally or associated with an anonymous Firebase account, as described in the Privacy Policy. Clearing app data, uninstalling the App, or losing access to a guest session may result in loss of guest data.

3. NFC tag use and writing

Only scan or write NFC tags that you own or are authorized to use. You are responsible for checking the tag and its contents before writing, overwriting, formatting, or sharing data.

Writing to a tag may overwrite existing information, make it unreadable to some devices, or change how another device or service responds to it. We are not responsible for data loss or damage caused by tag operations, incompatible tags, defective hardware, or misuse.

NFC tags may contain links, contact details, Wi-Fi credentials, or other sensitive information. Review content carefully before saving, writing, or sharing it. Do not use the App to access, copy, alter, or disclose information without permission.

4. QR code features

The camera may be used to scan QR codes, and QR codes may be generated on your device. You are responsible for reviewing a scanned link or payload before opening it and for checking generated content before sharing it.

QR codes and NFC tags can direct you to malicious websites or contain misleading content. The App does not guarantee that a scanned destination or payload is safe, accurate, or trustworthy.

5. Saved data and cloud services

Some features may let you save scan records to your account using Google Firebase services. Local activity and cloud-saved records may behave differently. Internet access may be required for sign-in and cloud synchronization.

You are responsible for the content you choose to save, write, or share. Do not save or transmit content that is unlawful, infringes another person's rights, or that you are not authorized to handle.

Data retention, deletion, guest-session limitations, and third-party processing are described in the Privacy Policy. You should keep your own copy of important information.

6. Acceptable use

You agree not to use the App to violate laws, compromise another person's privacy or security, distribute malicious links or payloads, interfere with the App or its services, reverse engineer the App except where applicable law permits, or bypass technical safeguards.

7. Third-party services

The App may depend on Google Sign-In, Google Play Services, Firebase Authentication, Cloud Firestore, and other third-party services. Those services may be governed by their own terms and policies. We do not control third-party services and are not responsible for their availability, content, or independent practices.

8. Availability, changes, and updates

We may modify, suspend, or discontinue features where reasonably necessary, including for maintenance, security, legal compliance, or changes to third-party services. We may release updates and recommend that you install them to maintain compatibility and security.

9. Intellectual property

The App and its original design, branding, software, and content are owned by or licensed to Xerxes Limited and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you. You retain rights to content you create, subject to any rights of others in that content.

10. Disclaimers

To the extent permitted by applicable law, the App is provided on an “as available” and “as is” basis without guarantees that it will be uninterrupted, error-free, compatible with every tag or device, or suitable for every purpose. We do not guarantee the safety or correctness of data stored on NFC tags, QR codes, or third-party destinations.

11. Limitation of liability

To the extent permitted by applicable law, Xerxes Limited will not be liable for indirect, incidental, special, consequential, or punitive losses, loss of data, loss of profits, or damage resulting from tag writing, device incompatibility, third-party services, or inability to use the App. Nothing in these Terms excludes liability that cannot legally be excluded.

12. Indemnity

To the extent permitted by applicable law, you are responsible for claims or losses arising from your unlawful use of the App, your violation of these Terms, or your infringement of another person's rights.

13. Privacy

Your use of the App is also subject to the NFC Tap Privacy Policy. Please review it to understand the information processed by the App and the choices available to you.

14. Termination

You may stop using the App at any time. We may restrict or terminate access where reasonably necessary to protect users, comply with law, address misuse, or protect the App and its services. Data deletion is handled as described in the Privacy Policy and may be subject to legal or technical retention requirements.

15. Changes to these Terms

We may update these Terms from time to time. We will publish the revised version in the App or at xerxes.ie/nfc-terms and update the effective date. Continued use after an update takes effect means you accept the revised Terms, to the extent permitted by law.

16. Governing law and contact

These Terms are governed by the laws of Ireland, without limiting any mandatory consumer rights that apply to you. The courts of Ireland will handle disputes, subject to applicable law.
